Terms and conditions for using PlayIQ Esports Academy services

By accessing or using PlayIQ Esports Academy's training platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
These terms constitute a legally binding agreement between you and PlayIQ Esports Academy. Your continued use of our platform after any modifications to these terms constitutes acceptance of the updated agreement.
To access our training programs, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 13 years old to create an account. Users under 18 should have parental consent before registering. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Your subscription grants you access to specified training modules, coaching sessions, and platform features according to your chosen membership tier. Access is personal and non-transferable, intended solely for your individual skill development.
You may not share account credentials, distribute training materials, or use our content for commercial purposes without explicit written permission. Violation of these terms may result in immediate account suspension or termination.
Subscription fees are billed in advance according to your chosen payment schedule. All fees are non-refundable except as specifically stated in our refund policy or required by applicable law.
You authorize us to charge your designated payment method for all applicable fees. If payment fails, we may suspend your access until payment is resolved. Price changes will be communicated at least 30 days in advance.
All content on our platform, including training materials, videos, assessments, and software, is protected by copyright, trademark, and other intellectual property laws. PlayIQ Esports Academy retains all rights to this content.
You may access and use our content solely for personal training purposes. Any reproduction, distribution, or commercial use of our materials without written permission is strictly prohibited and may result in legal action.
You agree to use our platform respectfully and constructively. Harassment, discrimination, cheating, or any behavior that disrupts the learning environment is strictly prohibited and may result in immediate account termination.
You are responsible for all content you submit, including communications with coaches and other users. We reserve the right to monitor, review, and remove any content that violates our community standards or these terms.
We strive to maintain continuous service availability but cannot guarantee uninterrupted access due to maintenance, technical issues, or circumstances beyond our control. We will provide advance notice of scheduled maintenance when possible.
PlayIQ reserves the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice of significant changes that may affect your training experience.
PlayIQ Esports Academy's liability is limited to the maximum extent permitted by law. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
Our total liability for any claims related to our services shall not exceed the amount you paid for your subscription in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
You agree to indemnify and hold harmless PlayIQ Esports Academy, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any rights of another party.
This indemnification obligation survives termination of your account and these terms. We reserve the right to assume exclusive defense of any matter subject to indemnification, at your expense.
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings, with cancellation taking effect at the end of your current billing period.
We may terminate your account immediately for violation of these terms, non-payment, or any conduct that we determine is harmful to our platform or other users. Upon termination, your access to all services will cease immediately.
Any disputes arising from these terms or your use of our services will be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court.
Arbitration will be conducted by a neutral arbitrator in accordance with established arbitration rules. You waive any right to participate in class action lawsuits or class-wide arbitration against PlayIQ Esports Academy.
These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of New York.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
We may update these terms periodically to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated through email and prominent platform notices at least 30 days before taking effect.
Your continued use of our services after the effective date of any changes constitutes acceptance of the updated terms. If you do not agree to the changes, you must discontinue use of our services and cancel your subscription.
